More About Chapter 7 Bankruptcy Forms...
Under the new bankruptcy law, more documentation is required than previously. While the information below is not guaranteed to be complete and your lawyer may require additional information and/or documents, having this information available and providing as many completed as possible documents can save your time and money.
A List Documents required to be filed for chapter 7 bankruptcy:
Bankruptcy petition
List of creditors
Schedule of your assets and liabilities
Schedule of your current income and expenses
Statement of your financial affairs
Certificate from your attorney or bankruptcy petition preparer (if there is one) stating you have received a notice describing the bankruptcy chapters and services available from the required credit counseling agency as well as a statement specifying that anyone who knowingly or fraudently conceals assets or lies under oath is subject to fine, imprisonment, or both. If no one helped you prepare your petition, you must file a certificate that you received such notice from the bankruptcy court and read it.
Copies of all pay stubs you received with the 60 days before filing
An itemized statement of your monthly net income showing how it is calculated
A statement listing any reasonably anticipated increases in your income or expenses for the next 12 months
If you have property that secures a debt (usually a home and/or car), a statement of your intention with regard to the treatment of the property in bankruptcy
A certificate from an approved credit counseling agency that describes the services provided and a copy of your debt repayment plan (if any) developed by that agency
A record of any interest you have in an individual retirement account,
An analysis of the bankruptcy chapter 7 means test
You can prepare some or most of these documents yourself. In order to help your bankruptcy attorney complete any documents, take the following information with you when you consult the attorney about filing bankruptcy.
Copies of all bills or letters you've received from a collection agency
A copy of any lawsuit and pleading you received that involves you
Deeds to real estate you are purchasing or already own. This includes real estate in which you have any interest.
Appraisals of your home, jewelry, or other valuable articles if you have them.
Titles or other documents showing the value of any cars, trucks, motorcycles, trailers, and motor home you own or are buying.
Life insurance policies for your and your family. If the policy has a cash surrender value, you will need that information also.
Two pay stubs representing an average pay period. Include two pay stubs for your spouse even if they are not filing for bankruptcy with you.
Your income tax return for the previous two years
